Quick Decision Framework#
Short Answer
Do not read a verified XM profile as SEC permission. The Securities and Exchange Commission has published an advisory against XM and has listed a cease-and-desist order against the Trading Point company that operates the brand. The country record is Forex Brokers in the Philippines 2026.
Detailed Explanation
Section 11 of the Securities Regulation Code is the SEC's basis for treating commodity futures, including forex undertaken as an investment, as suspended until the Commission adopts rules. The SEC repeated that position in an advisory signed on 17 August 2026. Bank foreign exchange for travel, trade, tuition and remittances is a different activity, supervised by the Bangko Sentral ng Pilipinas. A margin account on a currency pair is the activity the SEC has described as suspended.
A CySEC, FSCA, DFSA, Belize, Seychelles or CMA Kenya licence remains a foreign licence. The SEC's published point is that those licences do not authorise solicitation of investors in the Philippines.
Example
A worker in Cebu finishes KYC on a phone and sees a GCash tile on the cashier. The tile shows a payment brand. It does not withdraw the 14 March 2024 advisory, and it does not withdraw the December 2025 listing.
Common Mistake
Calling the advisory "just a scam warning about fake XM sites." The SEC text we rely on says the operator appears registered as a broker or dealer in other jurisdictions, and that it lacks Philippine authority. Those are different sentences.
Professional Tip
Open the live advisory and the issuances page yourself, and write the date in the same note as the company name from the entity checklist.
What the two SEC documents say#
Short Answer
One document is an advisory from March 2024. The later document is a cease-and-desist listing from December 2025. Verification sits in neither.
Detailed Explanation
| Record | Date on the SEC page | What we can say from the 28 September 2026 check |
|---|---|---|
| Advisory against XM | Signed 14 March 2024, posted 4 April 2024 | XM is not authorised to sell or offer securities, is not a Philippine corporation, and lacks authority under Sections 28 and 32. The text notes 1000:1 marketing, bonuses and copy trading |
| Issuances entry | 10 December 2025 | Names Trading Point Holdings Limited operating as XM (XM Group), XM.com, XM Global Limited and XM Philippines, and names endorsers |
| Press release | Posted 12 December 2025 | Title: SEC Issues Halt Order Against Trading Point, XM |
| Signed order PDF | Same matter | A scan. It was not text-searched. This note does not treat press descriptions of a bank freeze as a clause we verified inside that scan |
Re-open both URLs. Commissions update pages. A date in this article is the date of our hub check, not a promise that the web page is unchanged on the day you read it.
The documents we read do not describe a penalty aimed at a person who only opened an account. They do describe liability for people who sell, recruit or endorse. Section 73 is cited for a fine of up to 5 million pesos, imprisonment of up to 21 years, or both.
Example
A creator in Quezon City posts a referral link with a "passive income" caption. That is the enabler role the advisories describe. The creator's own verified trading login does not license the post.
Common Mistake
Assuming an affiliate disclaimer on a foreign website neutralises Philippine promoter rules. The SEC says the conduct can occur online.
Professional Tip
If you already published a link, take it down and read how to verify a broker licence. Do not replace it with a private group.
Wallets, bonuses and money already sent#
Short Answer
Stop. A working deposit button is not a licence, and a recovery agent is a second loss.
Detailed Explanation
G-Xchange (GCash) and Maya appear on the BSP list of supervised electronic-money issuers. That supervises the wallet. It does not give every merchant an SEC secondary licence. The Philippines hub notes that press reports of the XM order treated local banks and e-wallets as a sign the firm was targeting Philippine investors. We have not audited which buttons any cashier shows today, and this page will not tell you which button still works.
| Impulse | Why it fails |
|---|---|
| "Verified, so the order is old" | The firm's file does not edit the SEC site |
| Bonus or copy-trading credit | The 2024 advisory already flagged that marketing |
| Pay a person, then they load the account | Third-party funding hides the payer |
| Pay a recovery desk | You finance a second scheme |
| Teach a class using a live referral | Promoter exposure, as the advisories describe it |
This page does not set out a deposit, a withdrawal or a way around a freeze. If pesos have already moved, keep statements and speak to a Philippine lawyer or adviser. Scam warning signs cover the recovery-agent pattern.
Example
A platform credits a bonus after KYC and calls the bonus "SEC-friendly." The March 2024 advisory is the document that mentioned bonuses. A credit inside the platform does not answer it.
Common Mistake
Sending a small test deposit "just to see." A test is still a payment toward the activity the SEC has said is unauthorised.
Professional Tip
Use a demo if you want to learn the platform's buttons. Demo mode does not need GCash. Position size, if you ever trade under a licence that actually covers you, belongs in the lot size calculator.
Local clock#
Short Answer
The Philippines stays on UTC+8. The busiest London–New York window is late evening.
Detailed Explanation
In UK and US winter, that overlap is about 21:00–01:00 Philippine time. During UK and US summer, subtract one hour. There is no Philippine daylight-saving shift to track. The local weekend is Saturday and Sunday.
Session mechanics: market hours and slippage. Hours do not make a suspended product available.
Example
A reader in Davao checks gold at 22:30 in winter and sees the US data release. That is a study window. It is not a reason to ignore the issuances page.
Common Mistake
Treating a 24-hour cashier as proof the firm may solicit Philippine clients.
Professional Tip
Write the SEC check date next to the session note. If the advisory is still up, the session note stays educational.
Checklist#
- Read the 14 March 2024 advisory on the SEC site and record the date.
- Read the 10 December 2025 issuances entry and record the date.
- Do not treat foreign licences, KYC or wallet logos as a withdrawal of those pages.
- Do not publish referral links or run a paid class into the platform.
- If money has already moved, stop further payments and avoid recovery agents.
- For any firm that is not the subject of these orders, still use the brand versus entity checklist.
Glossary#
- SRC Section 11: the Securities Regulation Code provision the SEC cites for the suspension of commodity-futures activity, including forex as an investment.
- Advisory: a public SEC warning. The 14 March 2024 XM text says the firm is not authorised to sell or offer securities.
- Cease-and-desist listing: the 10 December 2025 issuances entry naming Trading Point Holdings Limited operating as XM.
- Secondary licence: SEC authority to deal in securities. Corporate registration alone is not that licence.
- EMI: an electronic-money issuer supervised by the Bangko Sentral. Supervision of the wallet is not supervision of the broker.
Risk warning: CFDs and leveraged forex can lose the entire deposit. The SEC says Philippine investors may have little or no local remedy against an unregistered foreign platform. This article is not legal, tax or investment advice.
Next step: read Forex Brokers in the Philippines 2026 and re-open the live SEC advisory and issuances pages. Do not fund or promote the platform from those documents.
